Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees using the monorail hoist system in the Save-All basement were exposed to the hazard of being struck by falling loads in that the monorail beam, its mountings and the trolleys were not inspected and tested on a periodic and regular basis to ensure that the monorail beam its mountings and trolleys were maintained in safe operating condition. The monorail beam, its mountings and trolleys which were deteriorated from the atmospheric conditions in the Save-All basement had not been periodically inspected and tested to ensure that the system was still capable of lifting loads within its rated capacity. Among others, one feasible and acceptable method to correct this hazard would be to implement a program of hoist inspection and testing that complies with ANSI B30.16, the American National Standard for Underhung Hoists, or ANSI B30.11 the American National Standard for Monorail Systems and Underhung Cranes, and to repair or remove from service any part of the monorail hoist system with defects noted during the inspections.
