Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: (a)Throughout Lincoln Park - A Landscape worker was observed riding in the bucket of a 310E Deere backhoe loader while unloading trees at various locations, on or about February 8, 2005. Among other methods, one feasible and acceptable abatement methods to correct the hazard is to train operators and other landscape workers to comply with the manufacturer's recommendations, warnings, and other aspects in the owner's manual for the John Deere 310E backhoe loader on the machine; prohibit employees from riding or standing in the bucket of the loader.
