Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from ladders: a.On or about November 16, 2005, at the front of the production yard, an employee was exposed to a six feet fall hazard when the employee used the top step of a 6-foot self-supporting ladder to access a concrete wall panel that was 6 feet and three inches high from the ground. Among other methods, one feasible and acceptable abatement metod to correct this hazard includes ensuring that manufacturer's warning labels are readable, ensuring that employees use a ladder of sufficient height which does not require an employee to step or stand higher than the step or rung indicated on the manufacturer's label marking the highest standing level of the ladder, and follow the guidance specified in American National Standard for Ladders Portable Reinforced Plastic Safety Requirements (ANSI A14.5-2000) Section 9.3.2 Climbing and Working Locations. ABATEMENT CERTIFICATION IS NOT REQUIRED.
