Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards from vehicular traffic:
a.On or about November 15, 2005, the employer failed to take steps to
ensure that
no employees were in the path of reversing vehicles with a restricted view
to the
rear.
Among other methods, some feasible means of abatement would be:
1.Strictly enforce the existing policy prohibiting employees from jumping
off docks.
2.Prohibit all employees from standing in the dock bay when a truck is
reversing/moving or has the potential to move.
3.Initiate a procedure which ensures that employees are not in danger areas
where and while highway trucks are maneuvering within the area, to
include, the use of high visibility vests by loading dock personnel who are
required to walk through areas with traffic and/or congestion; a policy
that
prohibits employees from working at the rear of trucks between the trailer
and dock; andn a system for notifying drivers when it is safe to enter dock
area.
4.Require an observer, spotter or reverse alarm on all limited visibility
vehicles during all reversing operations to safely direct the truck and
trailer into the dock.
5.Develop and implement procedures for employees serving as spotters for
drivers, to include where they will stand and how they will communicate
with drivers (e.g., verbal, hand signals, flags, etc.).
6.Install mirrors at the bay doors, and ensure lighting is ample.
