Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by falling trees/ branches
while pushing over trees
with an excavator:
a.On or about November 21, 2005, an employee was felling trees by pushing
them
over with a John Deere 490E Excavator that was not equipped with an
attachment
that was designed for tree felling & removal.  The employer did not use an
attachment to the excavator specifically designed to fell trees but used a
bucket
that was designed only for digging.  This process resulted in an
employee's death
when a falling tree struck the cab, crushing it down on the employee.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to use equipment specifically designed for tree felling
removal
operations.  Another means of abatement would be to manually fell the
trees.
ABATEMENT CERTIFICATION AND DOCUMENTATION IS
REQUIRED.TION
