Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling: a.On or about December 12, 2005, at the pump station, an employee was elevated in the bucket of a Komatsu PC 200 LC track hoe, exposed to an 8 feet fall hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to never allow employees to ride in or to work from a track hoe bucket, and to retrain all employees about working near and/or around heavy equipment. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
