Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard:
a.On or about January 5, 2006, the New Holland LX 865 Turbo Skid Steer was
not
maintained in a safe operating condition, in that the safety stop switch
located
under the driver's seat had been removed and bypassed and the wire mesh
located
on the sides of the operator cab had rusted away, exposing the operator to
a
possible crushing hazard.
Among other methods, feasible means of abatement would be:
1. The employer shall repair the safety stop switch and install new wire
mesh in
accordance with the manufacturer's specifications.
2. The employer shall conduct regular inspections of the skid steer in
accordance
with the operator's manual and NIOSH Alert Letter Publication No. 98-117.
The
employer shall repair any deficiencies before allowing employees to
operate the
skid steer.
