Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by material handling equipment and/or the
load:
a.On or about January 17, 2006, the 5/8-inch diameter wire rope that was
used to
pull the roll-off vacuum container onto the tow truck flatbed had
separation
among strands and crushed areas, exposing employees to the hazard of being
struck by the load and the wire rope.
ABATEMENT CERTIFICATION IS NOT REQUIRED.
b.On or about January 17, 2006, the tie-down chain assembly that was used
to pull
a 10,100-pound roll-off vacuum container onto a tow truck flatbed was
overloaded in that its working load limit was 2,650 pounds, exposing an
employee to the hazard of being struck by the load and the tie-down
assembly.
ABATEMENT CERTIFICATION IS NOT REQUIRED.
c.On or about January 17, 2006, the swivel hook that was used to pull a
10,100-
pound roll-off vacuum container onto a tow truck flatbed was overloaded in
that
its working load limit was 10,000 pounds, exposing employees to the hazard
of
being stuck by the load and swivel hook.
ABATEMENT CERTIFICATION IS REQUIRED.
Among other methods, a feasible means of abatement would be to:
1. purchase, install, use, and properly maintain rigging equipment such as
chains, slings,
wire ropes, and hooks that have sufficient working load ratings to safely
lift or pull the
intended loads, and to train employees how to safely install, use and
maintain the
equipment.
