Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the job site, located on the corner of Highway 89 and Highway 365, the boom angle indicator was missing from the boom of the Skytrak 8042, Serial No. 0255, Telehandler rough terrain forklift truck, exposing employees to the hazards of being crushed by the vehicle and/or load in the event of a tip-over.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees are exposed to: At the job site, located on the corner of Highway 89 and Highway 365, the seat belt of the Skytrak Telehandler, Model 8042, had been removed, exposing employees to the hazards of being ejected from and/or crushed by the vehicle or the material being handled in the event of a tip-over. Among other feasible methods, one feasible and acceptable abatement method to correct the hazard is to order and install a retrofit seat belt kit from the manufacturer of the vehicle and to require and enforce the use of the seat belt.
