Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being ejected from the forklifts during tight turns or being crushed by theforklift in the event of roll over: a. On or about 3/8/05 in the warehouse - employees were observed operating forklifts in an unsafe manner in that the use of restraint devices were not utilized. Among other methods, one feasible method is to comply with the requirements of the American Society of Mechanical Engieers document ASME B56.1-1993; Safety Standard for Low Lifts and High Lift Trucks, Section 7.39 Operator Restraint devices.t
