Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: (a)Station 7, A Line Assembly - An employee used a 6-foot fiber glass step ladder to access the top of an air handling unit, 7 feet 9 inches high. The employee had to stand on the top cap and top step of the ladder to reach the top of the air handling unit. The ladder manufacturer's label indicated the highest standing level as 3 feet 10 inches, on or about June 6, 2005. Among other methods, one feasible and acceptable abatement method to correct this hazard includes using a ladder of sufficient height which does not require an employee to step or stand higher than the step or rung indicated on the manufacturer's label marking the highest standing level of the ladder and which does not require an employee to step or stand on the top cap or top step of a step ladder as specified in the American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements (ANSI A14.5-2000), Section 9.3.2 Climbing and Working Locations. VERIFICATION REQUIRED
