Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or like to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards from the working in the swing radius of a excavator: (a)Avenue A, Mechanicsburg Pennsylvania - An employee was potentially exposed to a struck by hazard while standing in the swing radius of a Hitachi 270LC excavator, on or about March 30, 2006. ABATEMENT METHOD: A feasible means of abatement to correct this hazard barricade the area to restrict access and instruct employees not to enter the work area. VERIFICATION REQUIREDTION
