Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to severe burn injuries from a potential dust explosion
hazard that could have
resulted from, or been exacerbated by the a) failure to install properly
designed hoods, caputure
devices or enclosures on dust producing equipment b) failure to install
ductwork that was as
straight and as short as possible c)  failure to clean dust with a
nonsparking scoop and soft
natural fiber bristle brooms, and d)  failure to implement a training
program on dust explosion
hazards:
(a)Sanding Department - Employees use Porter Cable and Burr King sanding
machines to sand aluminum parts.  The ductwork and exhaust system on the
machines was not designed properly to adequately capture all the dust
generated
during sanding operations, on or about May 31, 2006.
(b)Sanding Department - Employees use Porter Cable and Burr King sanding
machines to sand aluminum parts.  The ductwork used to capture the
combustible
aluminum dust was not as straight and as short as possible, on or about
May 31,
2006.
(c)Sanding Department - Employees use Porter Cable and Burr King sanding
machines to sand aluminum parts.  The combustible dust is swept into a
metal
dust pan for removal, on or about May 31, 2006.
(d)Sanding Department - Employees use Porter Cable and Burr King sanding
machines to sand aluminum parts.  A training program was not implemented to
inform employees about the hazards involved in the generation of
combustible
aluminum dusts.  The training program did not include the control of
ignition
sources (smoking, open flames, electric or gas cutting or welding, the use
of non-
sparking tools to be used for repairs or maintenance on the sanding
equipment),
proper cleaning methods, use of compressed air and vacuum systems, the
proper
design of work clothing (no wool, silk, or synthetic fabrics, no cuffed
trousers,
no pocket shirts, and no exposed metal on safety shoes), and proper
emergency
procedures to follow in case of an emergency,  on or about May 31, 2006.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method
to correct these hazards (a) through (d) is to comply with National Fire
Protection Association
484, "Standard for Combustible Metals, Metal Powders, and Metal Dusts".
This includes the
following:
(a)Install properly designed ductwork and collection system per Section
4.3.2.1 of
the NFPA 484.
(b)Install straight and short ductwork per Section 4.3.2.3 of NFPA 484.
(c)Utilize nonsparking dust pans and natural fiber bristled brooms per
Section4.4.2.2
of NFPA 484.
(d)Develop a training program on aluminum dust explosion hazards per
Section
4.5.6 of NFPA 484.
