Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard. (a)Finishing Building - The eight foot fiberglass step ladder had a broken support at the base of the ladder but was not taken out of service, on or about January 22, 2007. VERIFICATION REQUIRED AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO FOLLOW ANSI A14-5 2000 FOR "Ladders - Portable Reinforced Plastic - Safety Requirements" which requires broken ladders to be mark and removed from service.
