Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:
(a)Date of Violation:02/14/05
Condition:Employees were allowed to ride in the rear of the box van which
was not suitable for
passengers, and without a means of communication or visual contact with
the operator.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to implement
enforcement of the company rules prohibiting the riding in or on the rear
of company vehicles while not
engaged in actual placement of containers; train employees in the specific
hazards associated with working in
and around box vans; develop and implement a means of communication
between employees and prohibit the
movement of the box van without the operator having visual contact with
coworkers.
Abatement documentation (photographs, receipts, copies of programs,
training certification, etc.)
is required for this item.
