A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees from the employer's failure to ensure that all power industrial trucks are equipped with operator restraint devices, including seat belts, and that operators use the devices while operating such trucks. Both the ANSI B56.1, consensus standard for powered industrial trucks, and ASME B56.1-2000 - Safety Standard for Low Lift and High Lift Trucks, recognize the hazard of forklift tip-over and the need for operators to use an operator restraint system, such as a seat belt: a) Loading dock/warehouse: The Shipping and Receiving Foreman was operating a Komatsu forklift, model #FG25ST 11 and serial #404952A, that was lacking a seat belt.ng
