Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from an overturning forklift due to the fact that the operator restraint system provided on the equipment was not used by the driver of the equipment. a)An employee was exposed to crushing injury while driving a 15,000 lb forklift over rough terrain without wearing the seat belt which was installed on the equipment. One feasible and acceptable abatement method to correct this hazard is to effectively enforce the use of seatbelts while operating forklift trucks provided with restraint systems as required byANSI B56.1-1993.
