Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the Hwy 7 & Westinghouse Road construction site in Hot Springs, AR, an employee was exposed to crushing injuries while the Terex Square Shooter Rough Terrain Forklift, model SS1048, serial number 981046 was operated without the use of a seat belt to move materials at this site. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a policy that requires: the use of seat belts, communication of the policy to employees, and enforcement of the use of seat belts.
