North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to hazards by operating the Western Lifts with
missing or damages rack lock
rods:
a)service area - for the employees who operate the Model WLO70A Western
Lifts - 7000 pound
capacity, with missing rack lock rods to lift vehicles.
b)service area - for the employees who operate the Model WLO70A Western
Lifts - 7000 pound
capacity, with bent rack lock rods.
Among other methods, one feasible and acceptable abatement method to
correct these hazards would be to
ensure that all rack lock rods were in place and undamaged when vehicles
are lifted by the Western Lifts.

4.4.2  The operator shall use all applicable safety features provided on
the automotive lift, and operate the lift
in accordance with the instructions furnished by the lift manufacturer.
4.4.4  The lift owner or employer shall take all appropriate steps to
follow the recommended inspection
procedures of the lift manufacturer, but in no event shall the lift
operator fail to inspect or take notice of the
following features on a daily basis:
(4) proper operation of the lift controls, restraints and locking devices;

employees who operate the
hydraulic lifts:
a)service area - there were no procedures in place to train employees in
the safe operation of the
Model WLO70A Western Lifts - 7000 pound capacity.
Among other methods, one feasible and acceptable abatement method to
correct these hazards would be to
initiate a training program for all employee who operate hydraulic lifts.

properly instructed or trained in
accordance with this standard and manufactured supplies instruction.

WLO70A Western Lifts
- 7000 pound capacity.

inspect all hydraulic lifts as recommended by their manufacturer.

5.1  Qualified Inspection Procedure.  The owner or employer shall
establish a periodic inspection procedure in
accordance with the recommendations of the lift manufacturer in order to
ensure reliability and allow the safe
operation of the lift.
