North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)project; 114 N. Center St. - employees working in the SkyTrak forklift, approximately 12 feet above the ground, were not protected from falling by a means of personal fall protection such as the type referenced un ANSI B56.6- 1992. ANSI B56.6-1992 - Section 5 General Safety Practices: 5.15.1 Elevating Personnel - (k) be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyard(s), etc. are in place and properly used.
