North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)establishment, alignment rack - where an In-ground Semi Hydraulic Lift was missing its "safety pin" to prevent lift from falling. The employees were not trained to recognize the hazard or to remove defective equipment out of service. Abatement note: One feasible and acceptable abatement method, among others, to correct this hazard is provide operator training to recognize hazards, and to ensure that the lift is not used until the repairs have been made. [Reference ANSI B153.1-1981; Safety Requirements for the construction, care and use of automotive lifts, Section 6: Maintenance, Use, and Inspection. 6.1 Maintenance. Maintenance procedures shall be described by lift manufacturer. The owner or employer shall maintain and care for the lift to ensure its continued safe operation.]r.

Abatement note: One feasible and acceptable abatement method, among others, to correct this hazard is provide periodic qualified inspections. [Reference ANSI B153.1-1981; Safety Requirements for the construction, care and use of automotive lifts, Section 6: Maintenance, Use, and Inspection. 6.3 Inspection. The owner or employer shall establish a periodic inspection procedure as recommended by the manufacturer to ensure the safe operation of the lift.]
