North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)to being crushed by or caught between in the event of an upset of the forklift. The employees operating the two Allis Chambers forklifts, Model #ACC-30, Serial #30283, forklift #1 & Serial #Unknown forklift #2 were not provided with seatbelts on and prior to 4/27/05. Among others, one feasible and acceptable abatement method would be to provide seatbelts in the forklifts and require the employees to use them while operating the forklifts.
