North Carolina General Statute #95-129(1) of the Occupation Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being crushed between the personnel work platform and the concrete floor of the construction site as a result of the employer not having the personnel work platform firmly anchored to the lifting carriage and/or the forks of the of the fork lift that was used to lift the employees up to their work area which was approximately 14 feet above the lower level. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT TO CORRECT THIS HAZARD IS TO ASSURE THAT THE PERSONNEL WORK PLATFORM WAS FIRMLY SECURED TO THE LIFTING CARRIAGE AND/OR FORKS".
