North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exosed to: a)being struck by a falling load from an overloaded crane. In the shop area, a bottom running floor mounted jib crane had not been load tested prior to initial use. Reference: ANSI B30.11-1980; paragraph 11-2.2.2(a) Rated Load Test - Prior to initial use, all the equipment mentioned in the above paragraph is to be tested... NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to load test all cranes as per ANSI B30.11-1980. b)being struck by a falling load from a crane that had not been inspected prior to use. In the shop area, a bottom running floor mounted jib crane and hoist had not been inspected periodically. Reference: ANSI B30.16-1981; Chapter 16-2, Section 16-2.1, Inspecting, Paragraph 16.2.1.3, Periodic Inspection. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to conduct periodic inspections on all cranes and hoists as outlined in the above listed reference. c)being struck by a falling load from an overloaded crane. Test load certificates were not available to review, verifying the load capacity of the crane. In the shop area, no load test reports were available for the bottom running floor mounted jib crane. Reference: ANSI B 30.11-1980; paragraph 11-2.2.2(a) - Test reports shall be placed on file. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to conduct the load testing initially and annually, and have the test reports readily available. d)being struck by a falling load being lifted with a hoist having a non-functional upper limit switch. In the shop area, the upper limit switch on the hoist being used with the bottom running floor mounted jib crane had not been tested before each use. Reference: ANSI B30.11-1998, Section 11-2.2, Testing, Paragraph 11-2.2.1, Operational Tests. NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to test the upper limit switch of each hoist before each use or shift.
