What this inspection record means

OSHA opens inspections for many reasons — routine scheduling under a national or local emphasis program, an employee complaint or referral, or a follow-up after a reported injury. Opening or conducting an inspection is not itself an allegation or a finding that this employer broke any rule; any findings appear as the citations listed below, and citations can be contested, reduced, or withdrawn.

North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina: The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to:
a)Being crushed by a forklift in the event of a roll over, due to the lack
of the forklift
being equipped with a seatbelt. In the plant area, the yellow Clark
forklift, model C-500-120, was equipped with rollover protection, but was
lacking a seatbelt. If a
rollover occurred, an employee could try to leave the forklift or be
tossed from the
operator's seat, and be crushed by the forklift.
Reference: ASME B56.1-1993, revision of ASME/ANSI B56.1-1988, paragraph
5.3.19 - An
active operator protection device or system, when provided, shall be used.
Operator protection
in the event of tipover is intended to reduce the risk of entrapment of
the head and torso
between the truck and the ground....
NOTE: Among other methods, one feasible and acceptable abatement method
to correct this
hazard is to use the retrofit kit or other approved means (as per the
manufacturer) to install a
seatbelt on the forklift.
