North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:
a)truck and automotive repair shop, employees
were exposed to struck-by and caught between
hazards from automotive lifts.  Employer
utilized 37 lifts (including WS15 15,000 lbs
Whip, WFP30R 30,000 lbs. Whip) and the
employer did not maintain lifts through
regular preventive maintenance and
inspections.
b)truck and automotive repair shop, employees
were exposed to struck-by and caught between
hazards from automotive lifts.  Employer
utilized 37 lifts (including WS15 15,000 lbs
Whip, WFP30R 30,000 lbs. Whip) and the
employer did not have a training program how
to maintain and operate the lifts.
NOTE:  Among other methods, one feasible and acceptable method to
abate this hazards includes the following:
1- Comply with the ANSI/ALI ALOIM-2000 Automotive Lift
Institute Standard for Automotive Lifts- Safety
Requirements for Operation, Inspection and
Maintenance.
