Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees:
At Quality Truck and Equipment employees were exposed to struck by hazards
while using
the mechanical transmission jack, a portable automotive lifting device
(PALD), to elevate and
install truck components.  The transmission jack in use had a caster that
was broken,
prohibiting the unit from rolling freely and the lifting mechanism was
severely worn and
loose.  The unit also did not contain the appropriate load ratings and
warning labels.
Furthermore the unit was not inspected before each use nor was it removed
from service
when defects were present.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to:
a.Repair, inspect, and ensure the unit is functioning in accordance with
the
ASME PALD (Portable Automotive Lifting Devices);
b.Replace the unit with a portable automotive lifting device that meets the
requirements of the ASME PALD; and/or,
c.Discontinue the use of portable automotive lifting devices in the
facility.
