Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Arby's jobsite/approximately 16 feet above grade. An employee, working from a pallet being raised by a fork lift, was exposed to fall related hazards. The employee was not provided any means of fall protection and the operator left the controls of the forklift. Among the feasible means of abatement would be to comply with ASME/ANSI B56.1 - 1992, Safety Standard for Rough Terrain Forklift Trucks CORRECTED DURING INSPECTION
