employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
Niemann Foods, Inc. d/b/a County Market #518 exposed employees to fall
hazards of
approximately 8 feet, while performing work from a pallet lifted by a
powered industrial
truck.  The pallet used did not meet the design, construction, and use
requirements as
outlined in The American National Standards Institute (ASME) ASME B56.1 -
2004, "Safety
Standard for Low and High Lift Trucks."
Among other feasible and acceptable methods to correct this hazard is to
provide a platform
that meets the requirements stated in ASME B56.1 - 2004, paragraph 7.37.
Another feasible and acceptable method to correct this hazard is to use
the company's scissor
lift, which contained the required guardrails to prevent employee exposure
to fall hazards.
