Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to falling down the elevator shaft or being crushed by moving elevator. a)Elevator shaft doors on the 1st floor and basement. The elevator shaft doors did not firmly latch closed when the elevator was not on those floors, causing employees to be exposed to falls of up to approximately 14 feet to bottom of shaft below, on or about 3/7/05. b)Elevator car doors (gates) inside the elevator. The elevator car doors (gates) were permanently tied open and the interlocks were electronically bypassed, causing employees to be exposed to crushing injuries between the elevator and elevator shaft wall, on or about 3/7/05. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS: to follow ASME A 17.3-1993 Safety Code for Existing Elevators. Section 2.7.1 "Hoistway Door or Gate Locking Devices" which states that these gates require electromechanical interlocks to keep them closed when the elevator is moving, and Section 2.7.4 "Restricted Opening of Hoistway Doors" which states that the hoistway door shall prevent the opening of the door when the elevator is not in the landing zone. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
