Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the following conditions:
a)On or about 06/21/05, employees and subcontractor employees were exposed
to
a struck-by and caught-between hazard because the crane operator was not
retrained following two near miss incidents, and on 06/21/05, overturned a
Grove
RT990 mobile hydraulic crane while traveling with a wire line deck weighing
approximately 11,647 pounds at the National Oilwell Varco South Yard. While
performing this pick and carry operation, the operator did not insure that
the
mechanical swing lock was locked, did not maintain the boom within the
defined
arc of six degrees on either side of the longitudinal centerline of the
machine, did
not ensure tires were inflated to recommended pressure prior to lifting on
rubber,
did not make due allowance for uneven ground conditions as described in
the load
charts for the crane.  Among others, one feasible and acceptable method to
abate
the condition would be to insure that designated crane operators are
qualified by
requiring them to pass a practical examination, limited to the specific
type
equipment to be operated, as described in USA Standard B30.5-1968, Section
5-
3.1.2, and to retrain operators involved in near miss incidents when
investigation
indicates retraining could prevent further incidents.
