Section 5(a)(1) of the Occupational Safety and Health Act of 1970:    The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the following conditions:  On or about September 25, 2005,
employees
potentially and actually exposed to anhydrous ammonia from the
refrigeration system did not
have access to at least two gas masks. Among others, two feasible and
acceptable method to
correct this hazard are to comply with:  (1) IIAR Bulletin No. 110 3/93,
which requires in
Appendix D.4 that "Protective clothing, goggles, respirators, and gloves,
carefully and safely
stored, shall be readily available in the vicinity of the system but
externally to the area of risk."
(2) The OSHA standard for anhydrous ammonia, 29 CFR 1910.111, which makes
recommendations that could be implemented by the employer for the health
and safety of
employees.  Paragraph (b)(10)(ii) states that "Stationary storage
installations must have at least
two suitable gas masks in readily-accessible locations.  Full-face masks
with ammonia canisters
that have been approved by NIOSH under 42 CFR part 84 are suitable for
emergency action
involving most anhydrous ammonia leaks, particularly leaks that occur
outdoors.  For respiratory
protection in concentrated ammonia atmospheres, a self-contained breathing
apparatus is
required."

piping for the
anhydrous ammonia refrigeration system was not labeled.  Among others, one
feasible and
acceptable method of abatement would be to comply with ANSI/ASME
A13.1-1996, Scheme
for the Identification of Piping Systems, which requires labeling of
piping
systems as to content
and indication of direction of flow with the use of legends, arrows, and
color-coding for
purposes of uniformity and safety of personnel and emergency response
personnel/entities.
