29 CFR 1926.95(a): The employer did not provide protective equipment,
including personal protective
equipment for eyes, face, head, and extremities, protective clothing,
respiratory devices, and protective
shields and barriers, which shall be provided, used, and maintained in a
sanitary and reliable condition
wherever it is necessary by reason of hazards of processes or environment,
chemical hazards,
radiological hazards, or mechanical irritants encountered in a manner
capable of causing injury or
impairment in the function of any part of the body through absorption,
inhalation or physical contact:
(a)On or about January 13, 2006, at 13242 CR 469 - Donaldson #1 and #2
wells,
the employer did not ensure that employees operating earthmoving equipment
used seat belts to prevent employee exposure to the hazard of being crushed
in the event of a rollover.
In the alternative:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did
not furnish employment and a place of employment which were free from
recognized
hazards that were causing or likely to cause death or physical harm in
that employees
were exposed to the hazard of being crushed:
(a)On or about January 13, 2006, at 13242 CR 469 - Donaldson #1 and #2
wells,
the employer did not ensure that employees operating earthmoving equipment
wore seat belts to prevent employee exposure to the hazard of being crushed
in the event of a rollover.
Among other methods, one feasible and acceptable method to correct this
hazard is to
ensure that equipment operators wear a seatbelt in accordance with the
requirements
of the John Deere Operator's Manual.
