Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by the forklift or falling
materials while unloading
pipes from the truck and did not verify the presence and location of
another worker near the
unloading operation:
(a)On or about June 21, 2006 a truck driver employee standing adjacent to
his load
was exposed to the hazard of being struck by falling pipes 44 feet in
length, 9 5/8
inches diameter and weighing 2343 pounds each, during the offloading
operations.
Among other methods, feasible and acceptable methods to abate this hazard
would be to follow
practices used by companies and/or corporations which perform similar
delivery operations by:
(1) a work rule and training for forklift operators that they must insure
that no workers are in
or near the path of travel (danger zone) during loading or unloading
operations: (2) establishing
and implementing a policy that requires all drivers to remain in a safe
zone, outside the radius
of work in progress; (3) to include documented periodic spot checks to
ensure that truck drivers
are adhering to established safety requirements.
