29 CFR Section 5 (a) (1) of the Occupational Safety & Health Act of 1970: and the: Vermont Statutes : TITLE 21 Labor : CHAPTER 3. SAFETY: Sub chapter 5. Occupational Safety and Health : 223. Duties. (a) : The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or significant physical harm to his employees; in that, employees were exposed to a fall hazard from the collapse of a temporary stairway that was not anchored properly and the employer shall comply with safety and health standards promulgated under the VOSHA Code. Location: Wedgewood Development, Lot #4, Porters Point, Colchester, Vermont Violation: The employer failed to provide a workplace free from recognized fall hazards when the stairway to the basement was not secured effectively, which exposed employees to a hazard likely to cause death or serious physical harm. The stairway to the basement was anchored to the header by a 2x12 plank which contained several cracks in it and three 16 penny nails. The 2x12 plank contained several cracks which affected its use in this application. The integrity of the wood had been compromised over time due to attaching and removing the plank at other job sites. The stairway was held up by three16 penny nails which were 3 1/2 inches long. After the nails went through the 2 inch plank only 1 1/2 to 2 inches, from each of the three nails, was able to sink into the header. The stairway should have been able to hold five times the anticipated load or a minimum of 1000 pounds, per ANSI A1264.1. Evidence of the hazard: An accident on 1/10/06 when the stairway system collapsed under the weight of 705 pounds. Feasible methods to correct the hazard: A new plank or a plank in serviceable condition, attached with more than 3 nails and/or larger nails (20d are 4 inches long instead of the 16d which were only 3 1/2 inches long), vertical supports under the stairway to carry the load and stakes at base of stairs for stability so that the stairway is capable of carrying five time the anticipated load or a minimum of 1000 pounds..
