29 CFR 1926.201(a)(1):  Signaling by flaggers and the use of flaggers,
shall conform to Part VI of
the Manual on Uniformed Traffic Control Devices, (1988 Edition, Revision 3
or Millennium Edition),
which are incorporated by reference in 1926.200(g)(2)
Location: Junctions of Memorial Drive, Railroad Ave and Hastings Hill
Saint Johnsbury, Vermont
Violation: The employer did not furnish to each of the employees a place
of employment which was
free from struck-by or crushing hazards, in that, the employer did not
provide adequate training as
stated in Safe Traffic Control Practices in the "Manual on Uniform Traffic
Control Devices", section
6E.01 B.  The employees were not equipped to be able to recognize the
hazards, prior to employees
entering into the zone of danger to direct traffic.  The flagger, John
Welch stood with his back to the
traffic, when a stopped vehicle accelerated and drove past him and through
the one lane work area,
without having been directed to do so.   Because Mr. Welch's back was to
the
stopped vehicle he did
not have the ability to react to the emergency situation (MUTCD,6E.01 E).
The employees training
should also include facing the road users (MUTCD, 6E.04 A), which will
enable the flagger to be
alert to the dangers and whereabouts of the vehicles he is controlling.
