21 VSA Title 23, Chapter 3, Sub-chapter5, Section 223 (a), Section 5 (a) (1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards associated with fork lift tip overs. Location: Yard area, throughout facility in Williamstown Violation: The employer did not ensure the employees safety and provide protection against recognized crushing/fatality hazards that could cause or were likely to cause death or serious physical harm to employees, in that, the employees were exposed to crushing hazards associated with fork lift tip overs and not wearing the required seat belt when they operated the Toyota and Clark forklifts. Among other methods, feasible and acceptable to correct the hazards include but is not limited to: a) clasp seat belts around employee before operating forklift b) repair or replace damaged seat belts if or when necessary c) install seat belt refit modification kit if lift does not contain one
