North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a caught between hazard: a)within the facility, garage, employees, operating a Komatsu Forklift, Model Number F625, Serial Number 141892A, were not provided with a seatbelt, when the forklift was equipped with a Roll Over Protective Structure. NOTE:Among other methods, one feasible and acceptable method to abate this hazard is to install a seatbelt on the forklift.
