Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) Front of shop: An employee was struck in the face by a metal rod which he was using to remove the pin from a bucket attached to the boom of the excavator which was parked on an incline, on or about May 17, 2005. Feasible and acceptable methods for correcting this hazard include: Following the procedures outlined in the Caterpillar SENR1934-05 "Disassembly and Assembly" maintenance manual when performing maintenance on CAT excavators.
