Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an excavator rollover hazard: a)691 Midland Avenue - Rear Yard: An employee was injured while operating a Bobcat 325 compact excavator which tipped over while lifting a section of concrete wall, on June 10, 2005. Note: Among other methods, feasible and acceptable abatement methods to correct to this hazard are: 1.Follow manufacturer's rated lift capacity for the Bobcat 325 excavator while handling sections of concrete wall. 2.Use material handling equipment capable of lifting larger section of concrete wall.
