Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to broken bones from falls greater than 10 feet:
a) 11 Washington Lane: An unsecured pallet was placed on the forks
of the forklift and was being used as a personnel lift platform for
access to the upper floor.   The laborer was exposed to greater
than 10 foot falls while assisting in application of panels while
standing on a wood pallet which was lifted by a JLG fork life, on
or about July 25, 2005.
NOTE:  Feasible and acceptable methods to correct this hazard include:
(1)Follow guidelines listed in the American Society of Mechanical
Engineers (ASME) B56.1
2000, Safety Standards for Powered Industrial Trucks, Section 4.17
Elevating Personnel
with a High Lift Truck designed to elevate personnel, and Section 7.36
Platforms
Elevating provide the restraining means such as railing, chains, cables,
body belts with
lanyards, or deceleration devices that are in place and properly used.
(2)Provide a "safety platform" used in accordance with ANSI B56.1-1975,
Part
II, Section
513, or equivalent protection.
