Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed the hazard of falling objects due to a lack of safety latches on hoist hooks: a)Copper House: The four (4) hooks of the spreader bar on the North American Industries 3 ton hoist on the copper side of the building were missing safety latches, on or about 11/29/2005. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to equip the hooks with safety latches as described in ANSI B30.16-1993 Section 16-1.2.9 (Hooks). A latch shall be provided to bridge the throat opening of the hook and retain, under slack conditions, such items as, but not limited to, slings and chains.
