Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling load: a)Workplace / Cutting Room: The hook of a 9 ft 4" rigging boom attached to a KOMATSU forklift was not equiped with a safety latch, on or about 12/14/05. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to equip the hook with safety latches. A latch shall be provided to bridge the throat opening of the hook and retain, under slack conditions, such items as, but not limited to, slings and chains.
