Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard from the order picker. a)Warehouse: An employee was elevated approximately sixteen feet above the ground in a Yale #30 order picker without any fall arrest equipment, on or about 1/23/2006. ABATEMENT NOTE: Section 4.17(c) of ASME 56.1-2000 requires that whenever an operator-up high lift truck is used to elevate personnel, restraining means such as railings, chains, cable, body belt(s) with lanyard(s), or deceleration devices, are in place and properly used. Although ASME standard calls for the use of body belts, OSHA strongly encourages employers to use body harnesses in place of body belts.
