Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crush hazard: a)700 Commercial Avenue, Carlstadt, NJ: A switcher was caught between the wheels and the trailer and fatally injured trying to uncouple a fifth wheel from a trailer while a driver was operating the tractor, on or about 02/17/2006. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to train employees in the steps outlined in the 03/20/1998 Roadway Safety Bulletin and in the 1998 Roadway Express Safety Update #44 : Trailer Uncoupling video regarding how to uncouple a fifth wheel if the fifth wheel latch is difficult to release using a one person procedure and to enforce the use of the procedure.
