Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a tip over hazard: a) 165 Chubb Ave., Lyndhurst, NJ: An employee operating a 1996 TOYOTA 5FBE18 forklift, was not wearing a seatbelt, on or about 11/09/06. Abatement Note: Among feasible and acceptable abatement methods to correct this hazard is to train forklift operators and ensure the proper use of restraint system while operating forklifts as referenced in ITSDF B56.1-2005 and operator's manual (TOYOTA Operator's and Owner's Manual).
