Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being crushed/pinched or death: Facility: The Moffett Mounty M5000 spider fork truck was not equipped with a device, such as (but not limited to) restraint device, system or an enclosure to protect the operator from the hazards of entrapment in the event of a tip over. On or about June 01, 2005, the operator of the spider fork truck was thrown out from the cab and crushed/pinched under the truck when the truck lost balance and tipped over. Among other methods, one feasible and acceptable means of abatement is to: 1. Equip the vehicle with a replacement seat and seat belt. 2. Utilize a restraint device, system or and enclosure for the vehicle. 3. Utilize other means of engineering feasibility.
