Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to falling load hazards:
On or about November 21,2005, employees were attempting removing a stuck
floor buffing
machine from the Autoquip Mechanical Freighlifts elevator located in the
plant were exposed
to falling load hazards due to the absence of an elevator inspection
program. The elevator had
not been inspected since it was installed approximately 5 years ago.
Employees working in the
elevator were exposed to hazards associated with the freight only elevator
free fell 18 feet, 6
inches to the bottom floor below.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is: Implement an elevator inspection program as recommended by the
manufacture
of the
Auto Mechanical Freightlifts and ASME A17.1-1996, Part X, Section 1000,
Rule 1000.1
thru 1000.3.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
