Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment free
from recognized
hazards that were causing, or likely to cause, death or serious physical
harm to employees.
On or about March 21-24, 2005, Ameritex Rentals, Ltd, as an exposing and
creating employer
did not ensure that scissor lifts were inspected and repaired prior to
delivering them to the
jobsite for use.  On March 23, 2004 workers located at a jobsite in
Bedford, TX utilized a JLG
Model 2646E2 scissor lift that was not equipped with a safety chain
(midrail) potentially
exposing its users to a fall hazard greater than 15 feet onto a concrete
surface.  In addition, the
rented equipment was not equipped with a copy of ANSI/SIA A92.6 - 1999
Manual of
Responsibilities for Dealers, Owners, Users, Operators, Lessors, Lessees,
and Brokers of Self-
Propelled Elevating Work Platforms, as well as the operating and
maintenance manuals as
required.  In addition, records of pre-delivery preparation performed
prior to each delivery were
not being maintained.
Among other methods, some feasible and acceptable methods to correct this
hazard are:
1.Develop and implement a company policy for the use of scissors lifts to
ensure
compliance with ANSI/SIA A92.6-1999 Self-Propelled Elevating Work
Platforms, specifically
section 5, entitled:
