Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm. 1. The employer did not ensure that employees were clear of the high pressure lines during fracturing operation. 2. Develop a daily pre-job process to ensure that management in the trailer and the employees working outside are aware of the current conditions of the operation before work begins. On September 14, 2005 at 7498 Mosier View Court an employee performing fracturing operations was fatally injured when he was struck by a pipe to his chest and right side of his body. Feasible and acceptable method to correct this hazard is: 1. Require all employees to stay clear of the high pressure lines. 2. Ensure that management in the trailer is aware of the current conditions of the operation before instructing employees outside. 3. Ensure that employees are comfortable communicating the working conditions with management.
